MATERNITY OR PATERNITY LEAVE: Absence of the working mother or father for a given period in which they are unable to work within the scope of protection of parenthood. This leave lasts for 120 consecutive days (increased by 30 days per each twin, in addition to the first). Of these 120 days, 90 must be taken after childbirth and the remaining totally or partially before or after the child is born. The mother must take a six-week leave after childbirth, and the remaining period may also be used by the father in case of death or physical or psychological incapacity of the mother, or joint decision of the parents. This leave is considered as actual work done, granting the right to an allowance paid by the social security, or a remuneration in the case of civil servants. Source: Law No. 99/03 of 27th August which approves the Labour Code (article 35 and No. 2, 3 and 4 of article 36); Law No. 35/04 of 29th July 2009, which regulates the Labour Code (article 68) (Adapted) PATERNITY LEAVE (5 DAYS): Grants the working father the right to a leave of five working days, which could be consecutive or intermittent, with a mandatory period in the first month after childbirth.
